A US judge has approved the proposed permanent injunction jointly proposed by publishers and the Internet Archive which will prevent the illegal distribution of the plaintiffs’ in-copyright books.
However the injunction will only apply to books for which the publisher has a commercially available e-book edition, as the 127 named works in the case all had e-book editions available, and there were no arguments made for print books not available in digital form.
The Internet Archive can still appeal the case and under the negotiated judgment they will be able to get this to the appeals court more quickly without the time and expense of a damages trial.
IA is now also being sued by music companies in the Southern District of New York over its "Great 78" programme, which collects vintage, 20th-century 78 rpm recordings, digitises them and makes them available to users for free.
